BTW, the House vote shouldn't come as a surprise, they pass this amendment pretty much every other year and it always dies in the Senate.
If you're looking for a good argument against this amendment, try and find some of Scalia's dissents in cases involving flag burning or campaign finance restrictions. Guy opposes them with about as much vigor as you.
Which actually makes me think, do you see the parallels between the two (burning and donating)? Do you agree with them?

But I support the right of anyone who wants to do so. Technically we're not suppost to wear the flag on clothing, but that didn't seem to stop Bush clothing his daughters in sweaters bearing the image. Do I care that someone puts the flag on a headband, or on the seat of their Harley, or paint their car with the colors? Not at all, and I think it's a HUGE waste of time and resources to be entertaining this kind of crap.

If this eventually passes, out of spite I'd also object to the flag being used in any kind of advertising, which is just as degrading.

Look this is real simple: If the people you govern are happy with their country and your governence they will never bother to burn its symbol in protest any way. If you remove this simple litmus test you can continue with impunity and have a way to discredit such actions as unpatriotic. I think these guys know that it is possible that a whole bunch of flag burning may be on its way and are moving premtively again..In light of this move to stifle disenting voices, what they seek to brand as unpatriotic may become the most patriotic thing you can do even if it hurts your soul to have to do it.

Personally, I think it's the only patriotic thing to do. After all, United States Flag Code 36s 176(k) states. "The flag, when it is in such condition that it is no longer a fitting emblem of display, should be destroyed in a dignified way, preferably by burning". This amendment, by reducing the flag to a symbol of our loss of free speach, would definitely make the flag "in such condition that it is no longer a fitting emblem of display".

Pehaps WB has a good idea.
If people do gather to burn flags have to make sure you can't be hit with local laws such as incineration, polution, etc
Also one could "Weasle" around the Law if it is passed.
One could Burn a flag for proper disposal!
I WOULD want our Troops to know that this has NOTHING to do with our Love and support for them.

Ah, flag burning. You know, most people don't know this, but in Oregon, over 3.8 thousand flags are burned ever day. Every day! Good lord, just try to walk down a street near the U of O in Eugene and you'll get third degree burns as a smoldering piece of charred flag blows right into your face.
Meanwhile, gangs of teenagers are signing up to visit nursing homes to spend time with elderly World War II vets...and when they come in for the visit, what happens...that's right, they pull out a small cloth flag and a zippo lighter, while screeching in the face of the old man they have come to visit, "CHOKE ON THIS, FASCIST!" as they apply the flame to the flag.
But it gets worse. Much, much worse. At Portland soup kitchens, people were complaining that the Monday night mashed potatoes tasted funny. It turned out a cook in the kitchen was BURNING THE FLAG AND MIXING IT INTO THE POTATOES!
And...oh, this is just horrible. Each and every Fourth of July, Boy Scout troops from Oregon and Washington gather by the thousands where they build tents out of flags and then, at night, for the campfire, you guessed it, FLAGS. The red, white and blue, desecrated by Boy Scouts as they sing CAMPFIRE SONGS! And then they make Flag S'mores.
Oh wait, none of that happens. Who is burning flags? Where is it happening? And is it happening so often that we need to put a stop to it? I think the last time I saw a U.S. flag being burned was on TV...in footage of protesters in Iraq.
Good thing the federal government has tons of cash to spend on discussing, debating and voting on an issue of such importance.
